Please read these Terms and Conditions (“Terms”) carefully before using the Zard platform. By registering for an account or using any service on Zard.sa, you agree to be legally bound by these Terms, as per Articles 5 and 10 of the Saudi Electronic Transactions Law.

These Terms are available in both Arabic and English. In case of any conflict, the Arabic version shall prevail.

Article 1: Definitions

• Platform / Zard Platform / Website / Zard Store: Refers to the online store (zard.sa) that allows merchants to offer products and services for sale, and consumers to purchase them.

• Goods: Refers to all products and services listed on the Zard platform.

• Merchant: A vendor offering goods via Zard.sa.

• Consumer: A customer purchasing goods through Zard.sa.

• Service Provider: A third-party entity such as shipping companies or payment gateways that supports the services offered on Zard.

Article 2: Communication

We may communicate with you electronically via email, SMS, platform messages, or push notifications. You agree that these communications satisfy legal requirements for written communication.

Article 3: Account Registration and Eligibility

You must provide accurate and complete information to register. We reserve the right to approve, deny, or verify your registration without obligation to disclose reasons.

Article 4: Representations and Warranties

You confirm and warrant that:

• You comply with these Terms in full.

• You are legally capable of entering into this agreement.

• If acting on behalf of a business, you are duly authorized to represent that business.

• You own or are authorized to share any content or data you submit, and it does not infringe on third-party rights.

Disclaimer:

Zard provides services “as is”, with no guarantees regarding merchantability, fitness for a particular purpose, or error-free operation. We do not guarantee the accuracy of product descriptions or third-party content.

Article 5: Account Use and Access License

Zard grants you a limited, non-exclusive, non-transferable, revocable license to use the platform for personal, non-commercial purposes, provided you comply with all applicable terms and fees.

You are responsible for:

• Securing your account and password.

• All activity under your account.

• Updating account information promptly.

You may not:

• Interfere with platform operations.

• Use the service for unlawful purposes.

• Reproduce or commercially exploit Zard content without written permission.

Article 6: Reviews, Comments, and Submissions

You may post content as long as it is not illegal, defamatory, infringing, or harmful. You grant Zard a perpetual, royalty-free, sublicensable license to use and share this content.

Zard reserves the right to remove content without notice and disclaims liability for user-generated content.

Article 7: Zard Applications

Zard applications must be used in compliance with these Terms and the terms of the application itself.

Article 8: Orders and Contracts

An order constitutes a purchase offer. A contract is formed only once Zard confirms shipment. You may receive multiple shipping confirmations if your order is shipped in parts.

You can cancel an order at no cost before a shipping confirmation is issued.

Invoices are issued electronically and sent to your email in PDF format.

Article 9: Returns and Exchanges

Returns and exchanges must be handled through the selling merchant. For more information, refer to our [Return Policy].

Article 10: Warranties

Warranty periods vary per product and are specified on the product page. Warranties apply only to products purchased within the Kingdom of Saudi Arabia. See [Warranty Policy] for full details.

Article 11: Prices and Availability

Prices include VAT and are shown before and after tax. Product availability is shown on each product page but may change. Zard reserves the right to correct pricing errors and adjust orders accordingly.

Article 12: Product Information

Product descriptions are for informational purposes only. Packaging or product contents may vary. You should read all manufacturer-provided documentation before use. Zard is not the manufacturer unless explicitly stated.

Article 13: Limitation of Liability

Zard is not liable for:

• Business-related losses (e.g., profit or data loss).

• Indirect or unforeseen damages.

• Defects or misuse of products purchased through Zard.

Article 14: International Shipping

If you purchase goods for international delivery, you are responsible for customs duties, compliance with import laws, and all related charges in your destination country.

All content on Zard.sa is protected by copyright and intellectual property laws. You may not extract, reproduce, or use any portion of the site’s content without written permission.

Article 16: Trademarks

“Zard” and the Zard logo are registered trademarks and may not be used without written consent. Other trademarks on the platform belong to their respective owners.

Article 18: Complaints and Legal Notices

To file a complaint or report rights infringement, please contact us. By submitting communications, you grant Zard the right to use, adapt, or share the information to resolve the issue.

Zard may update services, terms, or policies at any time. Your continued use of the platform constitutes acceptance of such changes.

Article 20: Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be settled exclusively by the competent courts of the Kingdom.
